These Terms and Conditions apply to your use of services provided by Borbolla & Figueiras Professional Services LLC under the DBAs AIstaffy and Acme Septic, including our website, onboarding, support, and any SMS messaging sent or received as part of the service ("Company," "we," "us," or "our").

By purchasing, using, or interacting with AIstaffy or Acme Septic, you agree to these Terms and Conditions. You must be 18 years or older to purchase or use this service.

1. Service Agreement and Onboarding Policy

AIstaffy requires a one-time $499 setup fee. Your first 30 days of service are included with setup. After the initial 30-day period, service is billed at $499 per month and renews automatically each month until cancelled.

You may cancel at any time to prevent future renewals. Cancellation takes effect at the end of your current billing period.

Work begins after you complete the required onboarding details, including your business information, hours, services, booking rules, and where leads should be routed. You are responsible for providing accurate information and promptly notifying us of any changes.

We provide 24/7 lead handling and booking based on your business information, availability, and rules. AIstaffy is not a lead generation or advertising service and does not guarantee lead volume, appointments, revenue, sales, or other specific business results.

2. Refund Policy

The one-time $499 setup fee is non-refundable. This fee covers the setup, configuration, customization, testing, and kickoff session required to build and launch your AIstaffy service.

Your first 30 days of service are included with your setup fee. No monthly subscription fee is charged during this initial 30-day period.

After your first 30 days, your subscription begins at $499 per month and renews automatically each month until cancelled.

Monthly subscription payments are non-refundable once processed. You may cancel your subscription at any time to prevent future monthly charges. Cancellation takes effect at the end of your current billing period, and your service will remain active through the end of that billing period.

3. Unlimited Usage and Fair Use

AIstaffy plans include unlimited AI calls and chats for normal business use. Unlimited usage is subject to reasonable and fair use and is intended for the normal operation of the subscribing service business.

Unlimited usage does not include abusive, fraudulent, automated, resold, or other usage that is inconsistent with the normal operation of the subscribing business. AIstaffy reserves the right to contact customers regarding unusual or excessive usage patterns and, when reasonably necessary, limit or suspend usage that violates this policy.

4. Messaging Consent

By providing your phone number and opting in, you consent to receive SMS messages from Borbolla & Figueiras Professional Services LLC DBA AIstaffy or Borbolla & Figueiras Professional Services LLC DBA Acme Septic, depending on the service or brand you engage with. Consent is obtained through website forms and onboarding forms where you check an SMS consent box. Consent is not a condition of purchase.

5. Message Types and Frequency

Messages sent by Borbolla & Figueiras Professional Services LLC DBA AIstaffy or Borbolla & Figueiras Professional Services LLC DBA Acme Septic may include transactional messages such as appointment reminders, order confirmations, account notifications, pricing or setup updates, scheduling updates, support messages, and responses to inquiries. If you separately consent, messages may also include marketing and promotional content. Message frequency varies.

6. Data Rates and Charges

Message and data rates may apply. These charges are determined by your mobile carrier, and Borbolla & Figueiras Professional Services LLC DBA AIstaffy or Borbolla & Figueiras Professional Services LLC DBA Acme Septic is not responsible for any messaging or data fees incurred.

7. Opt-Out Instructions

You may opt out of receiving SMS messages at any time by replying STOP to any message. After opting out, you will no longer receive SMS communications unless you re-consent.

8. Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information in connection with our SMS and business services.

9. Message Delivery

Borbolla & Figueiras Professional Services LLC DBA AIstaffy and Borbolla & Figueiras Professional Services LLC DBA Acme Septic do not guarantee that SMS messages will be delivered without delays or failures. Message delivery may be affected by factors outside our control, including carrier issues, network outages, device compatibility, or user settings.

10. User Obligations

You agree to use AIstaffy and its messaging services in compliance with all applicable laws and regulations. You may not use the service to send or facilitate communications that are unlawful, abusive, misleading, harassing, fraudulent, or infringe on the rights of others.

You are responsible for providing accurate and current information about your business, including your services, pricing, hours, availability, booking rules, and other information used by your AI assistant. You are also responsible for promptly notifying AIstaffy when this information changes.

You are responsible for reviewing your AI assistant's configuration and notifying us of any errors, inappropriate responses, or changes you would like made.

11. AI Service Limitations

AIstaffy uses artificial intelligence to answer calls, respond to inquiries, provide information, and perform configured actions based on the information and instructions provided by you. While the service is designed to provide accurate and helpful responses, artificial intelligence may occasionally misunderstand a request, provide an inaccurate or incomplete response, or fail to perform an intended action.

AIstaffy does not guarantee that every call, message, appointment, or interaction will be handled without error or interruption. You are responsible for reviewing the service's performance and promptly notifying us of any issues that require correction or adjustment.

AIstaffy should not be configured or relied upon to provide medical, legal, financial, emergency, or other professional advice where human judgment or licensed expertise is required.

12. Compliance With Laws

AIstaffy services are intended to be used in compliance with applicable federal, state, and local laws and regulations, including those related to privacy, telecommunications, call recording, artificial intelligence disclosures, and commercial messaging.

You are responsible for ensuring that your use of AIstaffy complies with laws and regulations applicable to your business, industry, location, and customers, including obtaining any required notices, disclosures, or consents.

AIstaffy may assist with configuring disclosures, consent language, and other service settings, but you remain responsible for determining the legal and regulatory requirements that apply to your business.

13. Changes to Terms and Conditions

Borbolla & Figueiras Professional Services LLC reserves the right to update or modify these Terms and Conditions from time to time. Updated Terms will be posted on our website with the revised effective date.

If we make a material change that affects your subscription, pricing, or use of the service, we will provide reasonable notice before the change takes effect. Your continued use of AIstaffy after the effective date of the updated Terms constitutes acceptance of the revised Terms.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Borbolla & Figueiras Professional Services LLC, including its DBA AIstaffy, will not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost business opportunities, or loss of data arising from or related to the use of, or inability to use, AIstaffy.

AIstaffy's total liability for any claim arising from or related to the service will not exceed the amount you paid to AIstaffy during the three months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations or exclusions of liability, so some of the limitations above may not apply to you.

15. Third-Party Services and Service Availability

AIstaffy relies on third-party platforms and service providers to provide certain features, including telecommunications, artificial intelligence, messaging, calendar integrations, hosting, and other technology services.

We cannot guarantee uninterrupted or error-free operation of services provided by third parties. AIstaffy is not responsible for outages, delays, delivery failures, service interruptions, or other issues caused by third-party providers, telecommunications carriers, internet service providers, or circumstances outside our reasonable control.

We may modify, replace, or discontinue a third-party provider or integration when reasonably necessary to maintain or improve the AIstaffy service.

16. Suspension and Termination

AIstaffy reserves the right to suspend or terminate service if payment is not received when due, if the service is used unlawfully or abusively, if these Terms and Conditions are materially violated, or if continued service could create a security, legal, regulatory, or operational risk.

When reasonably possible, we will provide notice and an opportunity to resolve the issue before suspending or terminating service. Immediate suspension or termination may occur when necessary to prevent fraud, unlawful activity, abuse, security threats, or harm to AIstaffy, its service providers, customers, or third parties.

Termination of service does not entitle you to a refund of the setup fee or any subscription fees already paid, except where otherwise required by applicable law.
